    1. Agreement to Terms

    By accessing or using www.capitalsourcemortgage.com ("Site"), submitting a loan inquiry, starting a loan review through our intake portal, or engaging with CapitalSource in any capacity, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use this Site or submit any information to CapitalSource.

    These Terms govern your use of the Site and your engagement with CapitalSource mortgage brokerage services. They do not constitute a loan agreement, commitment, or approval.

    2. Eligibility

    To use our services or submit a loan application, you must:

    • Be at least 18 years of age and legally able to enter into a binding contract
    • Be seeking mortgage financing for a property located in California or Hawaii
    • Provide accurate, complete, and truthful information in connection with any loan inquiry or application

    CapitalSource serves borrowers in California and Hawaii only. Inquiries from other states will not be processed.

    3. Nature of Services — Mortgage Brokerage

    CapitalSource operates as a mortgage broker. As your broker, we:

    • Evaluate your financial profile and identify potential loan programs across our wholesale lender network
    • Submit your loan application to third-party wholesale lenders for underwriting and funding
    • Facilitate communication between you, the lender, and third-party service providers (appraisers, title, escrow)
    • Do not make the final credit decision — lending decisions are made by the wholesale lender

    CapitalSource also operates as a direct lender under its DFPI California Finance Lender license for certain loan types. The applicable role (broker or direct lender) will be disclosed in your loan documents.

    4. Informational Purposes — No Commitment or Guarantee

    All content on this Site is provided for informational purposes only. Nothing on this Site constitutes:

    • A loan approval, commitment, or offer to lend
    • A guarantee of loan terms, rates, or program availability
    • Legal, tax, or financial advice

    Rates and terms displayed on this Site are illustrative, subject to change without notice, and are not guaranteed until a complete loan application has been submitted, reviewed, underwritten, and approved by the applicable lender. Loan approval is subject to borrower qualification, property eligibility, appraisal, title clearance, and lender underwriting guidelines.

    5. Accuracy of Information Provided

    You represent and warrant that all information submitted in connection with a loan inquiry, application, or communication with CapitalSource is accurate, complete, and not misleading. Submission of false or fraudulent information in connection with a mortgage application is a federal crime under 18 U.S.C. § 1014 and may result in criminal prosecution, civil liability, and denial of your application.

    CapitalSource is a dba of EquitySource, Inc. We operate under the following licenses:

    8. Reverse Mortgage Disclosures

    If you are inquiring about or applying for a reverse mortgage:

    • You must be at least 55 years of age for proprietary (jumbo) reverse mortgage programs, or 62 years of age for FHA-insured Home Equity Conversion Mortgages (HECMs)
    • Independent HUD-approved reverse mortgage counseling is required for HECM programs prior to loan application
    • A reverse mortgage is a loan — interest accrues and the loan balance increases over time
    • The loan becomes due and payable upon the borrower's death, sale of the property, or if the borrower no longer occupies the property as a primary residence
    • Failure to maintain the property, pay property taxes, and maintain homeowners insurance may result in default

    Proprietary reverse mortgage programs referenced on this Site are not government-insured products. Program availability, loan limits, and eligibility requirements vary by lender and are subject to change.

    9. HELOC and Cash-Out Refinance Disclosures

    Home Equity Lines of Credit (HELOCs) and cash-out refinance loans are secured by your home. Failure to make payments may result in foreclosure. These products carry the following considerations:

    • A HELOC is a revolving line of credit with a variable interest rate; your payment may increase if rates rise
    • A cash-out refinance replaces your existing mortgage with a new loan, potentially at a different rate and term

    To the fullest extent permitted by applicable law, EquitySource, Inc. dba CapitalSource, its officers, employees, and agents shall not be liable for:

    • Indirect, incidental, consequential, or punitive damages arising from your use of or inability to use this Site
    • Any errors or omissions in Site content
    • Any action taken in reliance on Site content
    • Unauthorized access to or alteration of your data

    Our total liability to you for any claim arising out of your use of this Site shall not exceed one hundred dollars ($100). Some jurisdictions do not allow limitations on liability; in such cases, the limitation above may not apply to you.

    These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict of law provisions. Any dispute arising out of or related to these Terms or your use of this Site shall be resolved in the state or federal courts located in Orange County, California. You consent to the personal jurisdiction of such courts.

    16. Changes to These Terms

    We may revise these Terms at any time. Updated Terms will be posted on this Site with a revised effective date. Your continued use of this Site following posting of updated Terms constitutes acceptance of those changes. Material changes will be communicated where practicable.
